$250.000 Application Deadline – Amendment to the Regulation on the Implementation of the Turkish Citizenship Law

As it is known, with the amendment (R.G.13.05.2022) made in the Regulation on the Implementation of the Turkish Citizenship Law (20.Article/2-b), the real estate acquisition value for the purpose of acquiring Turkish citizenship is determined by force after 1 month increased by $250.000 to $400.000

In this context, with the application amounting to $250.000, which was in effect until 13.06.2022, an instruction was issued to determine how the final transaction requests in the transition process would be resolved.

1-Until what date is the $250.000 application valid? – What is the $250.000 Application Deadline?

Applications to be made to our directorates in person or via webtapu/ALO181(webtapu) until 12.06.2022 at 24:00 will be evaluated for over 250,000 USD.
For example, an application made on 13.06.2022 is evaluated as over 400.000 USD.

2- Applications made through which channels will be considered valid?
Applications made via webtapu or ALO 181 (webtapu) until 12.06.2022 and 24:00 will be considered valid, e-appointment
Applications made via https://randevu.tkgm.gov.tr/tr/Appointment/eAppointmentStart will not be accepted as a party, and transaction information cannot be entered.

3-The application was made on 13.06.2022, but there are missing documents; in this case, what method does the land registry office follow?
If any documents that determine the value (currency purchase document, valuation report and receipt) are missing, the application is terminated by notifying the relevant person.

4- How long can the land registry directorate hold the application in case of missing documents other than the document determining the value?

In case of deficiencies arising from documents other than the documents determining the value, if the creditors do not apply to the directorate within 20 days, and if they do not apply to the directorate within 10 days, the relevant persons are notified via SMS. , the operation will be canceled”.

5- I applied before 5-13.06.2022, and my transaction was canceled because I could not determine the value. How will my application be evaluated after 13.06.2022?

Applications received until 12.06.2022 at 24:00 but canceled due to deficiencies in value-based documents (currency purchase document, valuation report and receipt) must be renewed after 13.06.2022, and new documents (currency purchase document, valuation report and receipt) are valued must be renewed accordingly. If it is determined that it was issued before 13.06.2022, the transaction is completed over the value of $250.000, regardless of the renewed application date.

6- I applied before 6-13.06.2022, and my transaction was canceled due to a lack of valuation. Could you explain with an example how my application will be evaluated after 13.06.2022?

If it is accidentally removed during the completion of other deficiencies, the commitment is renewed and the process continues.

7- What is the method to be applied if there is no deficiency in value-based documents at the stage of certificate of conformity (regional directorate) or there is a deficiency in other documents?

8- What is the method to be applied in case of deficiency in value-based documents at the stage of certificate of conformity (regional directorate)?

If the citizenship commitment has been taken, but the commitment is canceled due to the failure to provide the value of 250,000 USD sought at the stage of the conformity certificate or the incomplete documents (currency purchase document, valuation report and receipt) being canceled (with the exception of article 4, $400.000 value in the commitment transactions to be taken after 13.06.2022 is sought.

9- The immovable property was purchased before 13.06.2022, or an annotation of sale was made, but it cannot be sold for 3 years; no annotation/commitment has been put. Is it possible to put an annotation that has not been sold for 3 years after 13.06.2022 in order to benefit from 250.000?

If a preliminary sales contract has been drawn up at the notary, or if the sales or sales promise annotation has been registered with the land registry office, but a citizenship annotation/commitment has not been received and an annotation/commitment application has not been made within the body, 400,000 USD is sought within the framework of the procedures specified in the applications to be made after 13.06.2022.

10- The immovable property was purchased before 13.06.2022 or annotation was made for the promise of sale, but no annotation/commitment was made. Can you explain with an example, is it possible to put an annotation that has not been sold for 3 years after 13.06.2022 in order to benefit from $250,000?

Foreign nationals purchased the real estate no. BB. 101, 1 parcel, no. 1, on 11.06.2022, did not put an annotation/commitment for 3 years on the immovable. Foreign national BB applied to the land registry office on 20.01.2022 and applied for citizenship annotation/commitment.
In this case, even if the person makes a sale before 13.06.2022, the 3 years unsaleable citizenship annotation/commitment will be subject to the provisions of $400.000 since it is made after 13.06.2022.
